These Terms of Service ("Terms") govern your access to and use of the Trading Analytics website, applications, and related services (together, the "Service"). The Service is provided by Nowzana Technologies and is offered for research and educational purposes as described below.

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

The Service provides tools to design, simulate, and analyze technical trading strategies using historical or delayed market data. Outputs are hypothetical or historical simulations based on your inputs and available data.

The Service does not execute live trades on your behalf, does not hold customer funds for trading, and is not a stock exchange, commodities exchange, or crypto exchange. It is not a broker, dealer, investment adviser, or portfolio manager.

Nothing in the Service constitutes an offer or solicitation to buy or sell any security, derivative, or digital asset, or personalized investment, legal, or tax advice. You are solely responsible for decisions you make outside the Service, including any trading with third-party brokers or exchanges.

You must be at least eighteen (18) years old and have legal capacity to enter these Terms in your jurisdiction.

You agree to provide accurate registration information and to keep your credentials secure. You are responsible for all activity under your account unless you notify us promptly of unauthorized use according to the contact methods we make available.

We may suspend or terminate accounts that violate these Terms, pose security or legal risk, or abuse the Service.

We may offer free and paid subscription tiers. Paid plans are purchased on our main website (not inside this analytics application). Fees, billing cycles, taxes, and payment methods are shown there at purchase. You agree to pay all charges shown for the plan you select on that site, plus applicable taxes.

Access to paid features in this application is enabled manually by our team after we confirm payment on the main website. Renewal, cancellation, and refunds are governed by the terms presented at purchase on that site unless we specify otherwise.

We may change plan features or pricing with reasonable advance notice where required by law. Continued use after the effective date may constitute acceptance of the new terms for renewal periods.

Except where mandatory law provides otherwise, fees are generally non-refundable once a billing period has started. If we materially reduce core functionality of a paid tier you have purchased, we will describe any remedy (such as pro-rated credit) in a reasonable manner consistent with applicable law.

You will not misuse the Service. Without limitation, you will not: attempt to gain unauthorized access to systems or data; interfere with other users; reverse engineer the Service except where permitted by law; use the Service to violate any law or third-party rights; scrape or overload the Service in a way that impairs stability; or use outputs to mislead others about guaranteed returns.

You are responsible for complying with laws and regulations that apply to you, including those related to securities, derivatives, crypto-assets, data exports, and sanctions in your country of residence or access.

The Service may rely on data feeds, APIs, or integrations from third parties (for example, exchanges or data vendors). Such parties are not endorsed by us beyond what is needed to provide functionality. Data may be delayed, incomplete, adjusted, or erroneous.

Your use of third-party services (including brokerage or exchange accounts) is solely between you and those parties and is governed by their terms and policies.

We and our licensors own the Service, including software, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal research during your subscription or trial.

You retain rights to strategies and content you create, subject to our license to host, process, and display them as needed to operate the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Hypothetical or historical backtest results have inherent limitations and do not reflect liquidity, slippage, fees, outages, or future market conditions. Past or simulated performance is not indicative of future results.

To the maximum extent permitted by applicable law, we and our affiliates, officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, goodwill, or data, arising from your use of the Service or inability to use it, even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim, or (b) one hundred (100) US dollars, except where law does not permit such a cap.

You will defend, indemnify, and hold harmless us and our affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.

We may modify or discontinue features of the Service. We may update these Terms from time to time. We will post the revised Terms and update the "Last updated" date. If changes are material, we will provide reasonable notice where required by law. Continued use after the effective date may constitute acceptance.

These Terms are governed by the laws of India, without regard to conflict-of-law principles that would require application of another jurisdiction's laws, subject to any non-waivable consumer protections in your place of residence.

Courts located in India shall have exclusive jurisdiction over disputes arising from these Terms or the Service, unless mandatory law requires a different forum for consumers.
